1. Acceptance of Terms

Welcome to WanderSwipe.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and WanderSwipe ("WanderSwipe", "we", "our", or "us") governing your access to and use of the WanderSwipe website, mobile applications, and related services (collectively, the "Platform").

By accessing or using the Platform in any manner — including registering an account, browsing content, participating in trips, or interacting with any feature — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree with these Terms, you must discontinue your use of the Platform immediately.

WanderSwipe reserves the right to modify these Terms at any time. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

2. Who We Are

WanderSwipe is a travel discovery, social networking, and trip participation platform that enables users to discover destinations, connect with fellow travelers, participate in trips organized by independent organizers, share travel-related content, and engage with travel communities. Users may also book and pay for trips offered by independent Organizers, and purchase optional subscriptions for additional in-app features.

WanderSwipe does not itself organize, operate, conduct, manage, or supervise trips. It does process payments for paid bookings and subscriptions made through the Platform, and holds booking funds between payment and confirmation. See Section 9.

WanderSwipe is currently operated from Noida, Uttar Pradesh, India. Until a formal legal entity is incorporated, references to "WanderSwipe" refer to the owners, operators, affiliates, contractors, and authorized representatives responsible for operating the Platform.

3. Eligibility

The Platform is intended solely for individuals who are at least eighteen (18) years of age and possess the legal capacity to enter into binding agreements.

By creating an account or using the Platform, you represent and warrant that:

WanderSwipe reserves the right to refuse service, terminate accounts, or restrict access to any person at any time and for any reason, including in circumstances where eligibility requirements are not met.

4. User Accounts

4.1 Registration

To access certain features of the Platform, you must register for an account. You may register using an email address and password, Google Sign-In, or Apple Sign-In, where available. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify WanderSwipe immediately at support@wanderswipe.site upon becoming aware of any unauthorized use of your account or any other security breach. WanderSwipe will not be liable for any loss or damage arising from unauthorized access to your account that results from your failure to keep credentials secure.

4.3 Account Restrictions

You may not transfer, sell, or otherwise assign your account to any third party. You may not create multiple accounts for the same individual. Creating an account on behalf of another person or entity without authorization is prohibited.

4.4 Account Termination

You may delete your account at any time through the Profile section of the Platform or by contacting support@wanderswipe.site. WanderSwipe reserves the right to suspend or permanently terminate your account for violations of these Terms, fraud, harmful behavior, safety concerns, or for any other reason at WanderSwipe's sole discretion. Upon termination, your right to access and use the Platform ceases immediately.

When using the Platform, you agree not to:

All content you submit, post, or display through the Platform must comply with these Terms. You represent and warrant that you own or have the necessary rights, licenses, and permissions to submit such content and that such content does not violate any law or infringe the rights of any third party.

5.3 Reporting

WanderSwipe provides mechanisms to report content or users that violate these Terms. WanderSwipe reserves the right, but has no obligation, to review, remove, or restrict any content or account at its sole discretion.

6. User Generated Content

6.1 Your Content

The Platform allows users to create, upload, publish, and share content, including trip posts, destination reviews, comments, profile information, photographs, videos, voice notes, messages, and other materials ("User Content"). You retain ownership of User Content you submit, subject to the license granted below.

6.2 License to WanderSwipe

By submitting User Content to the Platform, you grant WanderSwipe a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to store, display, reproduce, distribute, process, modify for technical purposes, and use your User Content solely to operate and improve the Platform. This license continues for as long as reasonably necessary to fulfill operational and legal obligations. Upon account deletion, this license will terminate except where WanderSwipe is required to retain content for legal purposes.

6.3 Content Responsibility

You are solely responsible for the User Content you submit. WanderSwipe does not endorse any User Content. WanderSwipe reserves the right to remove, disable, restrict, or review any User Content that violates these Terms, applicable law, or WanderSwipe's community standards, with or without notice.

6.4 Public Content

Content you choose to make public may be visible to other users and may be searchable, indexable, or accessible to third parties. You should carefully consider what information you choose to make publicly available on the Platform.

7. Organizer Terms

7.1 Organizer Accounts

WanderSwipe may permit approved users ("Organizers") to create, promote, and manage trips and travel-related experiences through the Platform. Becoming an Organizer is subject to verification requirements and ongoing compliance with WanderSwipe's policies.

7.2 Organizer Verification

Organizer applicants may be required to complete verification procedures including, but not limited to, email verification, phone verification, PAN verification, GST verification, business registration verification, identity verification, and other documentation requirements. Verification is designed to improve user trust and safety. Acceptance as an Organizer is at WanderSwipe's sole discretion.

7.3 Organizer Obligations

Approved Organizers agree to:

Organizers are responsible for all content in their trip listings, including descriptions, pricing, photographs, itineraries, and terms. WanderSwipe may review, edit, reject, or remove listings at its discretion. Organizers must not list trips that are fraudulent, unsafe, misrepresented, or in violation of applicable law.

7.5 Independent Contractors

Organizers are independent contractors, not employees, agents, or partners of WanderSwipe. WanderSwipe does not supervise, direct, or control the activities of Organizers. WanderSwipe is not responsible for the acts, omissions, content, or representations of any Organizer.

7.6 Organizer Suspension or Removal

WanderSwipe may suspend, restrict, or permanently remove an Organizer for any reason, including false information, fraudulent activity, safety concerns, policy violations, repeated complaints, failure to maintain required permits, or conduct harmful to users or the Platform. Organizer status is a privilege and may be revoked at WanderSwipe's sole discretion.

8. Trips, Bookings, and Participation

8.1 Trip Listings

Trip listings on the Platform are created and managed by independent Organizers. WanderSwipe makes no representations or warranties regarding the accuracy, completeness, safety, quality, or legality of any trip listing or the activities described therein.

8.2 Booking and Participation

Users who book or express interest in trips do so at their own risk and discretion. By participating in a trip, you acknowledge that travel involves inherent risks, including but not limited to physical injury, illness, property damage, and circumstances beyond WanderSwipe's control.

8.3 Disputes Between Users and Organizers

Disputes arising between users and Organizers regarding trip quality, safety incidents, itinerary changes, or the conduct of a trip are primarily between the relevant user and the Organizer. WanderSwipe may, at its discretion, facilitate dispute resolution but is under no obligation to do so and does not guarantee any outcome.

Cancellations and refunds of bookings paid through the Platform are handled by WanderSwipe under Section 8.4 below, and are not left to the Organizer.

8.4 Cancellations and Refunds

If an organizer declines a paid booking, does not confirm it within the displayed confirmation window, or cancels it after confirmation through WanderSwipe, the traveler is entitled to a full refund of the booking amount paid through WanderSwipe.

Refunds are returned to the original payment method. Razorpay, the issuing bank, or the payment network controls the final processing time. A refund may be initiated immediately but can remain pending until the payment provider confirms it as processed.

WanderSwipe does not deduct an organizer cancellation fee from the traveler's refund. Payment-processing fees and taxes originally charged to WanderSwipe by the payment provider may not be returned to WanderSwipe.

The paragraphs above describe cancellations initiated by an Organizer. For trips that are not both booked and paid for through the Platform, cancellation and refund policies are set by individual Organizers and will be disclosed at the time of booking; users should review applicable policies before booking.

The Platform does not currently offer traveler-initiated cancellation of a paid booking. Travelers who need to cancel should contact WanderSwipe at support@wanderswipe.site.

A refund of a booking paid through the Platform is issued by WanderSwipe from the funds it holds, and is initiated automatically as soon as the cancelling event occurs. An Organizer's decline is refunded at once, and a booking whose confirmation window has closed is refunded by an automated process that runs hourly. Travelers do not need to request it.

This Section applies to trip bookings. Subscription refunds are governed by Section 9.5.

8.5 No Guarantee of Quality or Safety

Verification of an Organizer does not constitute a guarantee of trip safety, quality, legality, or the qualifications of the Organizer. Users are responsible for independently evaluating trips and Organizers before participating.

9. Payments

9.1 Payment Processing and WanderSwipe's Role

Paid trip bookings on the Platform are processed by WanderSwipe through its payment provider, Razorpay, using Razorpay Route. WanderSwipe is not a travel agency or tour operator, and processing payment does not make it a party to a trip or responsible for how a trip is conducted. Its payment role is limited to the movement of money, as follows. When a traveler pays for a booking:

Bookings cannot be made within 24 hours of a trip's departure. Only Organizers who are both verified by WanderSwipe and hold an activated payout account with the payment provider are able to offer paid trips.

WanderSwipe does not receive, store, or have access to complete card, UPI, or netbanking credentials. Those are collected and processed directly by Razorpay under its own terms and privacy practices. WanderSwipe stores a record of the transaction.

9.2 Pricing and Fees

All pricing for trips and services is as displayed at the time of booking. WanderSwipe may collect service fees, platform fees, or transaction fees in connection with payments facilitated through the Platform. Applicable fees will be disclosed before payment is completed.

WanderSwipe charges Organizers a platform commission on paid trip bookings. The commission is a percentage of the amount the traveler pays, and is currently 8%. Any change to that rate, and any different or additional fee, will be disclosed before it applies.

What an Organizer receives for a booking is the amount the traveler paid, less: WanderSwipe's platform commission; any cancellation fees the Organizer already owes under Section 9.3, which WanderSwipe may recover from a later payout; and any statutory deductions WanderSwipe is required to withhold under Indian tax law, which will be itemised in the Organizer's payout record. Payment-gateway charges levied by the payment provider on a booking are borne by WanderSwipe and are not deducted from an Organizer's share.

9.3 Organizer Payouts

WanderSwipe collects payment for paid bookings into its own account and holds the Organizer's share until the booking is confirmed, as described in Sections 8.4 and 9.1. Release of an Organizer's share is subject to completed payout-account verification with the payment provider, compliance checks, fraud reviews, applicable tax obligations, amounts the Organizer owes WanderSwipe under these Terms, and Platform policies. WanderSwipe reserves the right to withhold or delay a release pending investigation of suspected fraud or policy violations.

For each trip, an Organizer receives a cancellation allowance, currently equal to 10% of confirmed bookings on that trip, rounded down to a whole booking. Organizer confirmation timeouts and Organizer cancellations after confirmation consume this allowance. Once the allowance is exhausted, WanderSwipe assesses a cancellation fee, currently 3% of the affected booking amount, which may be recovered from a later Organizer payout. These are the rates in force today; any change will be disclosed before it applies.

An organizer may request an emergency waiver. Waivers require review and approval by a WanderSwipe administrator and are not automatic.

9.4 Taxes

Users and Organizers are responsible for all taxes applicable to their transactions and activities on the Platform. WanderSwipe may be required to collect, report, or remit certain taxes in accordance with applicable law.

9.5 Subscriptions

WanderSwipe offers optional paid subscriptions that increase the number of chat requests a user can send to other travelers in each billing period. Subscriptions are not required to use the Platform, and are separate from and unrelated to trip bookings.

The plans currently offered in India are:

Prices shown in the app are those displayed by Google Play at the time of purchase, in the user's local currency, and are authoritative. The amounts above are the standard India prices and may differ in other regions or during a promotion.

Auto-renewal. Subscriptions renew automatically at the end of each billing period, and you will be charged the then-current price for the next period, until you cancel. Renewal is handled by Google Play, or by our payment provider on the web; WanderSwipe does not charge you directly.

Cancellation. You may cancel at any time. Cancellation takes effect at the end of the period you have already paid for: you keep your subscription benefits until then, and you are not charged again.

Cancelling a subscription does not delete your WanderSwipe account, and removing the app from your device does not cancel your subscription.

Failed payments. If a renewal payment fails, Google Play or our payment provider will retry for a limited period. Subscription benefits continue during that grace period. If payment is not recovered, the subscription lapses and the user returns to the Free plan.

Refunds. Subscription purchases made through Google Play are refunded under Google Play's refund policy, and requests must be made to Google Play — WanderSwipe cannot issue a refund for a Google Play purchase. Subscriptions purchased on the web are handled by WanderSwipe. Subscription fees for a period already used are not refundable except where required by applicable law, including the Consumer Protection Act, 2019.

Changes to plans or pricing. WanderSwipe may change subscription pricing or plan benefits. Any price increase will be notified in advance and will apply only from a following billing period. Google Play will separately ask the user to accept a price increase before charging it; if it is not accepted, the subscription will not renew.

10. Intellectual Property

10.1 WanderSwipe's Intellectual Property

The Platform, including all software, features, content, designs, logos, trademarks, service marks, databases, and other materials created or owned by WanderSwipe, is protected by applicable intellectual property laws. These materials are the exclusive property of WanderSwipe or its licensors. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from WanderSwipe's materials without express written permission.

10.2 Feedback

If you provide suggestions, ideas, feedback, or recommendations regarding the Platform ("Feedback"), WanderSwipe may use such Feedback without restriction or compensation to you. You grant WanderSwipe a perpetual, irrevocable, worldwide, royalty-free license to use, incorporate, and exploit such Feedback in any manner.

10.3 Third-Party Content

The Platform may contain links to third-party websites or include third-party content. WanderSwipe does not own or control third-party content and is not responsible for its accuracy, legality, or appropriateness. Links to third-party sites do not imply endorsement.

11. Privacy

Your privacy is important to us. WanderSwipe's collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Platform, you consent to the practices described in the Privacy Policy.

12. Disclaimers

12.1 Platform Provided "As Is"

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, WanderSwipe expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title.

12.2 No Warranty of Accuracy

WanderSwipe does not warrant that information on the Platform is accurate, complete, reliable, current, or error-free. Trip listings, organizer information, and user-generated content are provided by third parties, and WanderSwipe makes no representations regarding their accuracy or completeness.

12.3 No Warranty of Availability

WanderSwipe does not warrant that the Platform will be available without interruption, error-free, secure, or free from viruses or other harmful components. WanderSwipe reserves the right to modify, suspend, or discontinue the Platform at any time without notice.

12.4 Travel Risks

Travel involves inherent risks. WanderSwipe is not responsible for incidents, accidents, injuries, illness, property damage, or other losses arising from travel activities facilitated through the Platform. Users participate in trips at their own risk.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, these limitations apply only to the extent permitted by applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless WanderSwipe and its owners, operators, affiliates, contractors, representatives, and authorized personnel from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

15. Dispute Resolution

15.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to contact WanderSwipe at support@wanderswipe.site and attempt to resolve the dispute informally. WanderSwipe will attempt to resolve disputes within thirty (30) days of receiving written notice.

15.2 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

15.3 Jurisdiction

Any disputes arising from these Terms that cannot be resolved informally shall be subject to the exclusive jurisdiction of courts located in Noida, Uttar Pradesh, India. You consent to the personal jurisdiction of such courts.

15.4 Consumer Redressal

Nothing in these Terms limits any rights you may have under applicable consumer protection laws in India, including the right to approach consumer redressal forums.

16. Termination

16.1 Termination by You

You may discontinue use of the Platform and delete your account at any time. Termination of your account does not affect obligations that arose prior to termination.

16.2 Termination by WanderSwipe

WanderSwipe may suspend or terminate your account or access to the Platform at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, fraudulent activity, harmful behavior, safety concerns, legal requirements, or operational reasons.

16.3 Effect of Termination

Upon termination, your right to access and use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

17. Changes to These Terms

WanderSwipe may modify or update these Terms from time to time due to new features, legal developments, regulatory requirements, operational changes, or other reasons.

17.1 Notification of Changes

Where appropriate, WanderSwipe may notify users of material changes through in-app notices, email communications, website announcements, or other reasonable means. We recommend reviewing these Terms periodically.

17.2 Continued Use

Continued use of the Platform following the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree with changes, you should discontinue use of the Platform and may request account deletion.

18. General Provisions

18.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional terms applicable to specific features or services, constitute the entire agreement between you and WanderSwipe regarding your use of the Platform and supersede all prior agreements.

18.2 Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18.3 No Waiver

WanderSwipe's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

18.4 Assignment

You may not assign or transfer these Terms or your account to any third party without WanderSwipe's prior written consent. WanderSwipe may assign these Terms and its rights hereunder without restriction in connection with a merger, acquisition, or sale of assets.

18.5 Force Majeure

WanderSwipe shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, war, civil unrest, pandemics, power failures, or internet outages.
